Environmental regulations have evolved rapidly in recent years leaving many organisations confused.
As a first step, waste producers should at the very least obtain proof that their waste management contractor is operating within the law.
Duty of Care
Section 34 of the Environmental Protection Act 1990 imposes a Duty of Care on persons concerned with controlled waste. Duty of Care applies to any person who produces, imports, carries, keeps, treats or disposes of controlled wastes, or as a broker has control of such waste.
Producers of controlled (industrial) wastes have a statutory responsibility to take all reasonable steps to keep wastes safe and prevent harm to human health or the environment including:
- Ensuring that waste is handled in accordance with a PPC Permit or Waste Management Licence
- Packaging and securely storing all waste materials appropriately and robustly
- Ensuring that waste is only transported and handled by an organisation authorised to do so
- Ensuring that the waste being transferred is accompanied by appropriate written documentation.
Hazardous Waste Regulations
The Hazardous Waste Regulations 2005 (amended in 2009) regulate the storage and disposal of certain clinical and medicinal wastes. It is the producer's responsibility to determine if waste is hazardous, although our expert team at novus environmental is on hand to advise you.
Organisations that produce more than 500kg of waste per annum need to be registered as a Hazardous Waste Producer with the Environment Agency. We will be unable to collect hazardous waste unless you are registered or qualify as exempt.
